Can I use this template AusCERT Membership and Services Terms and Schedules?

This AusCERT template agreement and the following guidelines are for use ONLY in the supply of AusCERT membership and related services by AusCERT, an organisational unit of Information Technology Services (“ITS”). A Service Schedule that incorporates the AusCERT Membership and Services terms (“Master Terms”) must be entered into BEFORE the supply of AusCERT membership or related services commences.

Please read the conditions of use below for information on when it is appropriate to use this agreement and how to prepare it. If the conditions of use are followed and no changes are made to the terms set out in the Master Terms, other than as allowed under those terms or the conditions of use below, an agreement may be formed by a prospective member submitting a duly completed and executed Service Schedule that incorporates the Master Terms.

Conditions of Use

  • The relevant Service Schedule has been completed including the full legal name and ABN/ACN of the prospective member, as well as the service, term and price details.
  • The relevant Service Schedule has been executed by the prospective member.
  • The Service Schedule submitted by the prospective member is based on the most current template of the Service Schedule and refers to the most current Master Terms as published on the Legal Office website.
  • No amendments have been made to the Master Terms except as allowed under those terms.
  • No Special Conditions have been included except as approved by the Director of Information Technology Services.
  • No Included Business Units have been included except as approved by the Director of Information Technology Services.
  • No amendment to standard pricing has been made except as approved by the Director of Information Technology Services or the Associate Director of AusCERT and University Networks.
  • No amendments to the Service Descriptions or AusCERT Policies have been made except as approved by the Director of Information Technology Services.
  • For clarity, the Director of Information Technology Services is authorised to:
  • Execute schedules containing Special Conditions that do not conflict with the Master Terms, for the University on behalf of the Chief Operating Officer;
  • Execute schedules that contain Included Business Units, for the University on behalf of the Chief Operating Officer; and
  • Approve amendments to pricing, service descriptions and AusCERT Policies.
  • For clarity, the Associate Director of AusCERT and University Networks is authorised to approve amendments to pricing.
  • Where a submitted Service Schedule does not meet any one of the Conditions of Use above, it must be rejected within 5 business days of the date on which it was submitted. Such rejection notice should include text to the effect of:

The Service Schedule submitted by you on [insert date] is hereby rejected by the University of Queensland, trading as AusCERT, in accordance with clause 2.5 of the AusCERT Membership and Services Terms”.

When to contact the ITS Legal Office

Please contact the Legal Officer assigned to ITS if you are seeking to:

  • amend the Master Terms, generally or in respect of a particular prospective member;
  • amend an AusCERT Policy;
  • amend a Service Description; or
  • include Special Conditions in a Service Schedule.

Steps when using the AusCERT Membership and Services Terms and Schedules

Upon receipt of a completed Service Schedule and Member Information Schedule from a prospective member please follow this process:

  1. Confirm the version of the template and Master Terms referenced are correct.
  2. Ensure the legal name of the prospective member is correct. You need to obtain a full legal name of the entity and an ACN (Australian Company Number) or ABN (Australian Business Number). Please confirm the organisation name and the ABN/ACN by using the ABN Lookup service.  
  3. Ensure that all details are correct, including the price and Schedule Term.
  4. Ensure the Service Schedule has been duly executed.
  5. Within 5 days of receipt, reject any Service Schedule that does not meet the Conditions of Use, by written notification to the party that submitted it.
  6. Where Special Conditions or Included Business Units are included, prepare the Service Schedule (in duplicate) for execution for the University by the Director of Information Technology Services on behalf of the Chief Operating Officer. 
  7. Keep a scan of any Service Schedule executed by the University for your records and return one executed original to the member, or where they do not require a hardcopy, provide them with a scanned copy.
  8. Retain the original fully executed copy of any University executed Service Schedule in a secure location.
  9. Where an existing Member submits a Service Schedule for renewal of Membership Services or in relation to any other service offered by AusCERT, following the same process as set out above. The following templates may be used to order additional services: Flying Squad Service Schedule.
