The University of Queensland Standard Conditions of Offer – For the purchase of goods/services

Whole of Government:

  • Conditions of Offer version 004 – dated 1 July 2012;
  • Invitation to Offer (template) Sections 1-5; and
  • Invitation to Offer (template) Section 6).

GUIDELINES

Conditions of Use

  • These documents may be used where UQ is requesting tenders for the purpose of purchasing of goods or services. 
  • The documents are not suitable for requesting tenders to purchase Information Technology equipment or software licences.
  • The Conditions of Offer reference the Whole of Government Conditions of Contract version 004 – dated 1 July 2012. These terms will therefore apply to any purchase made using the Conditions of Offer and the Invitation to Offer templates. There are separate guidelines on the Legal Office website that explain how to use the Conditions of Contract once the tender process is complete.
  • The purchase must be a low risk activity.
  • No amendments may be made to the Conditions of Offer or Invitation to Offer standard wording. If amendments are made the document is no longer considered ‘standard’ and must be reviewed by FBS Procurement before being used.
  • You must use the latest version of the Conditions of Offer and Invitation to Offer templates, downloaded from the Legal Office website each time.
  • You must obtain any relevant University approvals to issue the Conditions of Offer and Invitation to Offer templates as part of a tender process.
  • You must comply with UQ’s policies and procedures, including any relating to the conduct of a risk assessment, and UQ’s procurement procedures.
  • Where there are any insurance issues or enquires, you have contacted FBS at insurance@uq.edu.au for advice and/or resolution of same.

Steps when using these standard procurement contracts

The following steps are should be followed in using these documents in a tender process:

  1. Determine the applicable procurement process that should be followed as part of your tender (please liaise with FBS Procurement if you have any questions regarding the necessary processes).
  2. Complete the relevant sections of the Invitation to Offer templates.
  3. Issue the completed tender documentation to the prospective Offerors for their response.
  4. When you have selected your preferred Offeror, you will need to enter into a contract to purchase the good or service. As mentioned above, the Conditions of Offer stipulate that the Whole of Government Conditions of Contract version 004 – dated 1 July 2012 will apply to the transaction. There are separate guidelines on the Legal Office website to assist you in this process.

When to contact the Legal Office

FBS Procurement administers the Whole of Government contract processes, so please direct any questions to this division in the first instance.  FBS Procurement will refer any questions to the Legal Office if any amendments are necessary or legal assistance is otherwise needed to finalise the tender documentation.
